I know this is a radio and TV board, and not a sandwich board, but it looks like CBC is under attack once again, or at least the CBC Marketplace program is:
"Subway sued CBC, Marketplace host Charlsie Agro and others who worked on the show. It also sued Trent for defamation and negligence, arguing the testing was careless."

This would never happen at a private broadcaster.
(They would never dare speak against an advertiser...or potential advertiser)

I haven't eaten at Subway since the CBC Marketplace piece aired. I used to eat there 2-3 times a week - so that's probably $1000/year in revenue they've lost from me alone as a direct result of Marketplace. I can't be the only one.

Given that the original judge threw the lawsuit out I don't think there's much there, even if the appeal court decided that a trial should go ahead. Sounds more like Subway is playing the libel chill game and trying to bully news outlets to avoid criticism.

This is yet another value of having a public broadcaster. There are pluses, and there are minuses. IMHO, the pluses outweigh the minuses as far as the CBC is concerned.

Marketplace is one of the few CBC shows I enjoy. 8pm Friday is appointment viewing for me.

You'd never see CTV bashing horrid Bell phone/internet customer service or Rogers TV or Sportsnet do the same to it's telecomms arm or viciously criticize the Blue Jays...so I applaud the CBC...but over the past few seasons I've noticed Marketplace has become more sensationalized...an obvious effort to grab more attention as opposed to producing hard-hitting and in-depth journalism/reporting on bad business and consumer practices as they've done in the past...

The part with all of this, should Subway be successful, this will change things for the worse. There will be worry to do any story against any company, with facts and evidence in hand. The question should be if in fact the story was untruthful. Sadly I have trouble listening to a Subway paid lab giving the truth. A simple independent credible lab should be involved. Should they come back with anything close to the CBC story, then Subway's case should be thrown out. It just feels big money is pushing the courts around and not looking into the reality.

Marketplace branded content has been showing up more and more in CBC news programs over the past 7-8 years. For example World Report on CBC Radio will sometimes have a story that is actually a branded promotion for that coming Friday’s Marketplace. It takes time away from actual news reporting; a 15-second promo right before the hourly news would suffice instead of a 2-minute report.
Marketplace might have one good show per season but I find it otherwise unwatchable. I much prefer what Pat Foran does on CTV.

Ultimately though, is the tuna issue just in the States or also in Canada?
With CBC pointing out the chicken, I have no doubt that Subway's tuna here is also a mystery.

(at least this time, Marketplace can cover this and not be sued for being the original source of the story )

I recall it did happen a couple of times with Silverman Helps on City tv. Mainly with car companies, manufacturers and dealerships.
However the stories ran and so did the spots.
