Netflix To Ottawa: We'll Agree To Do CanCon, But It Has To Be Our Way

This is the streaming service's idea of a compromise. But will the government agree? And how will Canadian broadcasters react if they do? 

“Simply imposing the regulatory obligations of licensed Canadian broadcasters on online entertainment services would not be an appropriate approach,” [said Stéphane Cardin, Netflix’s director of public policy.] “Services like Netflix do not perform the same roles as traditional broadcasters, nor do we have the same content strategy.”

Cardin said imposing a 30 per cent spending requirement on online services wouldn’t be fair or equitable. He argued the company receives no regulatory benefits from the CRTC, and doesn’t carry news or live sports, the two categories where most of the traditional broadcasters’ CanCon funding is spent.


"He warned imposing stringent rules on online services could lead to some of them choosing not to enter the Canadian market."

And therein lies the threat. Rogers argues everyone should play by the same rules. While Corus took a clever tack, noting that yes, streaming services are a different animal - and as a result of the changes in the overall broadcasting landscape, everyone should have fewer and "less onerous" CanCon obligations in order to compete.

Netflix and others are actually asking for some flexibility, not demanding that it has to be there way. This seems reasonable since their circumstances are not the same as broadcasting.  And if the government is doing their job, any regulations or conditions for Netflix and others will reflect this.  Nobody in government as far as I am aware has said the regulations or conditions would be the same.

We could also see some changes in regulation or proposals for traditional broadcasters too.

Whenever working and negotiating with another group, it is usually best to drop the exaggerations and tough talk.  Netflix found this out a few years ago dealing with various governments around the world.
