- from InsideRadioThe latest copyright infringement lawsuit against a radio group is crossing U.S. borders. Los Angeles-based photography company FameFlynet Inc. has charged Canadian broadcaster Evanov Radio Group with using three images on the website of its rhythmic CHR “Z103.5” CIDC Orangeville, ON without permission.FameFlynet’s lawsuit is filed with the U.S. District Court’s Southern District of New York because the accuser says that the station—which is located in the Toronto region— and the website are “both marketed and readily available to residents to a large area of New York.”
In the suit obtained by Inside Radio, the three allegedly infringed photos are described as: “Shia LaBeouf and longtime girlfriend Mia Goth have gotten engaged” in one, and two different images captioned with “Mia Goth showing off her giant ring as she and Shia step out in Los Angeles.”As with so many similar suits, FameFlynet is asking for “up to $150,000 per infringement” plus court costs, as well as a trial to prove damages. The photography company earlier sued Cox Media Group, Ingstad Radio and other broadcasters.
And as the prevalence of "Google Image Search" becomes the norm for youngsters (either clueless or ignorant of DRM) entering the biz...I'd expect this to happen more regularly...and the corollary will be more photo owners patrolling usage of their images for possible financial windfalls.
