The Court ordered Jazz Fm to make listener email addresses available

In the continuing saga of Jazz Fm...here is the news release about today's court decision, to ensure the board at Jazz FM make the email addresses available to the group called Save Jazz FM...

Also, there is quite a more detailed piece about this on Jazz Fm's Facebook page which to me is quite "In your face" but changes need to happen...

I feel as a member donor, the station has definitely lost an edge and it's soul a little...

Jazz FM must pay $20,000 of the plaintiff's costs in addition to their own $30,000 in legal fees.  The last on air pledge drive raised only $186K of the $350K goal.  You have to wonder how much of this a "not for profit" can take.

December 14, 2018

Earlier today, the Superior Court of Justice heard the Commercial List Application between Brian Hemming and JAZZ.FM91. Justice Thomas Dunphy has ordered JAZZ.FM91 provide the email addresses of donor members to Mr. Hemming. The Justice denied that JAZZ.FM91 was obligated to provide donor member telephone numbers. Justice Dunphy also denied Mr. Hemming’s request that JAZZ.FM91 file three declarations.

JAZZ.FM91 values and respects the privacy of our donors. Counsel advised JAZZ.FM91 not to release donor member email addresses and phone numbers as there was no legal authority or precedence to do so. Moreover, to do so without a Court Order would have contravened our privacy policies.

JAZZ.FM91 will respect the order of the Court.

The Justice ordered JAZZ.FM91 to pay 40 per cent of Mr. Hemming’s total legal costs of $50,000.

We will have a further statement next week."

As an aside, I noticed that Renah Persofsky and Bernie Webber are no longer listed as Directors on the website.  I have no idea when that happened.

As you might recall, The Globe and Mail reported,

"The investigation began last March after the group wrote to the board of directors to allege “ongoing workplace harassment, sexual harassment, bullying, and general mismanagement of the station” by Porter. The letter also alleged that the station’s vice-president of finance and operations, Sharda Prashad, board chair Bernard Webber and vice-chair Renah Persofsky had enabled Porter’s alleged behaviour."

According to the SaveJazzFM FB page, the JazzFM91 Board has decided to appeal the above decision.  The judge's decision was quite clear and he even awarded costs to the plaintiff.  It's truly unbelievable.
